Acceptable Use Policy

1.0 General Information

HostBrr provides high-performance web hosting, virtual private servers (VPS), reseller plans, and high-capacity storage services to clients worldwide. The Acceptable Use Policy (AUP) is established to ensure we can consistently deliver the best possible service, high speeds, and maximum reliability to all our clients.

1.2

Clients registering and purchasing any service with HostBrr (hostbrr.com) explicitly agree to and are subject to our Terms of Service, Privacy Policy, and this Acceptable Use Policy.

1.3

The contents of this AUP are intended as baseline guidelines and are not meant to be exhaustive. Generally, any conduct that violates local/international laws, regulatory requirements, or the accepted norms of the internet is strictly prohibited even if not expressly mentioned in this document.

1.4

We reserve the right at all times to prohibit activities that we deem unacceptable and which could damage our infrastructure, performance, or reputation. HostBrr will be the sole and final arbiter as to what constitutes a violation of our policies.

2.0 Abuse Definitions

2.1
Resource Abuse Consists of any activity, intentional or otherwise, that consumes sufficient system hardware resources (such as CPU, I/O operations, network capacity, or database memory) to negatively affect other clients on the same physical host node or node cluster.
2.2
Unsolicited Communication Any email, SMS, or network-based communication sent in bulk or individually without the explicit, verifiable consent of the recipient. Knowingly permitting or initiating Unsolicited Communications is grounds for immediate termination and a permanent ban from any future service.
2.3
Malicious Content Any script, code, binary file, malware, or vulnerability exploits designed to perform harmful actions, either to affected visitors or as bulk actions. Includes hosting content in violation of German, United States, and Luxembourg regulations. Knowingly permitting or hosting Malicious Content is grounds for immediate termination and a permanent ban from any future service.

3.0 Actions & Remedies

3.1
Intentional / Malicious Usage Defined as any severe, destructive, or illegal action knowingly performed by the user (or persons authorized by the user to access the service) that matches the Abuse Definitions. This results in the immediate termination of all services on the user's account without compensation, except where court orders require holding evidence for law enforcement. The user will be permanently banned from holding any further services with HostBrr.
3.2
First / Unintentional Offense If a system compromise, exploit, or resource breach occurs unintentionally, the offending service will be suspended and brought offline. A high-priority support ticket will be opened detailing the offense and the necessary steps to resolve the issue. Once the client acknowledges and replies explaining how the issue will be corrected, the service will be reactivated and the client will have twenty-four (24) hours to prevent any further abuse.

4.0 Prohibited Usages

The following activities are strictly prohibited across all of our services. Partaking in or hosting any of these will result in immediate cancellation with zero notice and zero refund.

4.1

Hosting copyrighted content and/or linking to pirated content without explicit authorization.

4.2

Operating open proxies or VPN servers accessible to the general public.

4.3

Operating, hosting, or utilizing stress testers, booters, or network stress-testing tools.

4.4

Sending unsolicited or bulk messages via email or SMS (Mail/SMS bombers).

4.5

Running bulk email campaigns or sending unsolicited commercial mail (Mass e-mailing).

4.6

Running persistent heavy resource-intensive activities (CPU, I/O, Network) outside fair share allocation.

4.7

Spoofing or forging IP headers, routing tables, or packet payload identifiers (IP Spoofing).

4.8

Performing unauthorized port scans, host scans, or reconnaissance sweeps against external networks.

4.9

Distributing, hosting, or publishing login credentials, passwords, or personal identifying information.

4.10

Initiating, participating in, or facilitating Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks.

4.11

Operating Tor exit nodes or similar anonymizing router gateways.

4.12

Running open domain name system (DNS) recursive resolvers.

4.13

Cryptographic coin mining (Bitcoin, Monero, etc.) using CPU, I/O, or GPU resources without authorization.

4.14

Hosting "Hide Your IP" websites, anonymizing proxy scripts, or anonymous mail forwarding systems.

4.15

Conducting unauthorized vulnerability assessments, exploits, or penetration testing tools.

4.16

Initiating brute-force automated login tools, password dictionary scans, or dictionary-based attacks.

4.17

Software cracking, hosting, or distributing key generators, license bypass tools, or keygens.

4.18

Operating command and control nodes (C2), botnet agents, or hosting automated malware controllers.

4.19

Hosting or distributing pornographic material in violation of local hosting jurisdiction regulations.

4.20

Operating Usenet local spoolers, indexers, newsreaders, or newsgroups.

4.21

Destructive activities including but not limited to phishing, malware, ransomware, and/or distributing malicious content.

4.22

Illegal activities including but not limited to financial ponzi schemes, pyramid schemes, fake stores, or scam websites.

4.23

Pirated software distribution, license bypassing, or sharing of copyrighted tools.

5.0 Fair Usage Policy

5.1

Shared physical node resources such as CPU cycles, network interface ports, and disk I/O controllers are shared dynamically among clients on any given physical server.

5.2

If your virtual service is persistently saturating these resources for heavy, non-optimized workloads over a prolonged period and disrupting the experience of other clients on the same host node, we will contact you to request a reduction in your usage.

5.3

In severe or system-critical cases, we reserve the right to reboot, temporarily shut down, or suspend your VPS container to restore node stability for neighbor clients.

5.4

We will only intervene or act if the service quality or customer experience of other clients on the physical server is actively degraded by your high resource consumption.

5.5

If a client exceeds their allocated premium bandwidth limit on a VPS, we will automatically limit the network interface throughput speed to 10 Mbit/s to prevent sudden overage costs or host service interruption.
